History
The Fort Jeudy Association was established in 2000, when a number of concerned residents got together and agreed to establish an residents association to tackle some of the major issues that were affecting the Development, these including: (a) substandard maintenance work being carried out on the roads and other areas and (b) the construction of unapproved buildings within the development that violated one or more of the covenants governing the use of the land within the Development.
In 2000, with the agreement of Westerhall Fort Jeudy Ltd (WFJ), the Association started to collect maintenance dues on behalf of WFJ. These dues were used to undertake and finance various maintenance projects within the Development, including the patching some of the major roads and maintenance of the verges.
In 2002, with the agreement of WFJ, the owners of the Development, the Association took over the following responsibilities via Power of Attorney and Deed of Assignment:
1) To enforce all covenants, restrictions and stipulations and to prosecute any action or other proceedings in any Court of Justice.
2) To demand, collect, sue for, and take all necessary steps to recover the maintenance fee in accordance with the covenants, restrictions and stipulations contained in the conveyances.
3) To maintain and upkeep the roads, parks, verges and communal areas within the confines of the Development.
4) To give notices of any kind to any owners of property in the Development, including notices to remedy a breach of covenant.
5) To review all plans of proposed dwelling houses to be built within the Development, and to approve such plans upon compliance with the covenants, restrictions and stipulations contained in the conveyances.
7) To do all other things incidental to the above powers of which the Association thinks necessary or expedient in relation to Westerhall Fort Jeudy Ltd. as fully and effectually as the Company itself could do save and except that the Company will continue to maintain and upkeep the existing underground power lines and apparatus associated therewith.
